News from OIP: New Indices, Limited Meeting Checklist for Boards and Commissions, FY 2025 UIPA Log Report

Updated reference materialsOIP has updated its UIPA Index and Sunshine Law Index, which allow key word searches for OIP’s formal opinions by subject matter, and its Table of Statutes that are found on its Opinions page to include its latest formal opinions.  Only formal opinions are indexed by OIP, with separate indices for UIPA and Sunshine Law cases.  OIP has also updated its List of OIP Formal Opinion Letters providing the opinion numbers, issuance date, and short title of its main subject matter.  These tools make it easier for people to research and find relevant formal opinions on topics that OIP has already considered. 

New limited meeting checklist state and county boards subject to the Sunshine Law, part I of chapter 92, HRS, must generally hold public meetings.  Boards are allowed to hold limited meetings closed to the public under section 92-3.1, HRS, if the meeting location is dangerous, or the board must conduct an on-site inspection where public attendance is impracticable.  This could include situations where a board will hike on uneven terrain to view a location such as a river or watershed, or to view a facility on private property.  Boards must meet several requirements under section 92-3.1, HRS, in order to hold a limited meeting, including obtaining the OIP Director’s prior concurrence.  OIP has developed a new limited meeting checklist and revised its Request for Concurrence form – all in one document.  The checklist and form are available on OIP’s training tab at oip.hawaii.gov.   

2025 Log report: The FY 2025 UIPA Log Report, has been posted to the OIP website.  This report compiled record request data from 201 state agencies and 100 county agencies between July 1, 2024, through June 30, 2025.  Thank you to all state and county agencies that participated and provided their log data.
