Request for Election Information After Lease With Vendor Expired
On December 5, 2021, February 15, 2022, and May 19, 2022, Requester submitted three separate requests to the Office of Elections (OE) for access to the ballot images, cast vote records, and audit logs from the 2020 General Election. The OE denied each request, and Requester appealed the denials to OIP. OIP found that the OE had actual knowledge that the leased voting system for the 2020 Election did not save any in-person ballot images. With respect to the mail-in ballot images, cast vote records, and audit logs, OIP found that these requests were submitted to the OE after its lease with the vendor expired in December 2020. Because the OE was without access to the vendor’s proprietary software required to read any electronically stored 2020 Election data, and the OE had no contractual right to obtain the needed software from the vendor, OIP concluded that the OE did not maintain the requested election information.
