Director’s Calendar

Requester sought a decision as to whether the Department of Health (DOH) properly denied, under Part II of the UIPA, Requester’s request for a copy of the former DOH Director’s “public work calendar for the time period of July 11 through August 8, 2011.”

OIP found that the calendar kept by the former Director was not a “government record” subject to disclosure under the UIPA because, although maintained in the agency’s office, it was held or controlled by an employee personally and not in his or her official capacity as an employee of the agency. Consequently, DOH’s denial of Requester’s request is outside the scope of the UIPA and the jurisdiction of OIP.
