Sunshine Law and Uniform Information Practices Act
Complaints about Agendas and Meetings
Requester alleged several actions by the Hawaii County Board of Ethics (Board) violated the Sunshine Law and the Uniform Information Practices Act (UIPA) before and during two Board meetings on June 10, 2009 and July 8, 2009.
OIP found the following:
1. The June and July agendas provided sufficient public notice.
2. The evidence was insufficient to find that the Board discussed the
Requester’s petitions and made decisions in advance of the June meeting.3. Although notice of the June meeting was not timely mailed to Requester, there was no harm as he received actual notice six days before the meeting and participated in it.
4. The Board did not violate the UIPA by not immediately providing a letter requested during an open meeting.
