Civil Rights Commission’s Access to Employment Service Records

[OIP Op. Ltr. No. 05-03 partially overrules this opinion to the extent that it states or implies that the UIPA’s privacy exception in section 92F-13(1), HRS, either prohibits public disclosure or mandates confidentiality.]

Under the inter-agency disclosure provisions of the UIPA, the Department of Labor and Industrial Relations was found to have the authority to disclose otherwise confidential records relating to the State Employment Service to the Hawaii Civil Rights Commission (HCRC) in connection with the HCRC’s investigation of a discrimination complaint. The disclosure was reasonable proper for the performance of the commission’s duties and responsibilities.
