Inter-Agency Disclosure of Retiree’s Data

[OIP Op. Ltr. No. 05-03 partially overrules this opinion to the extent that it states or implies that the UIPA’s privacy exception in section 92F-13(1), HRS, either prohibits public disclosure or mandates confidentiality.]

Under the inter-agency disclosure authorization of the UIPA, the Employees Retirement System may disclose the home address of a retired public employee to the Department of Labor and Industrial Relations (“DLIR”) in connection with the enforcement of the State’s Wage and Hour Law. The former public employee is also an employer responsible for unpaid wage claims, and the disclosure of the information would directly further the DLIR’s performance of its statutory duty to enforce labor laws.
