BILL ENACTED TO TREAT POLICE OFFICERS’ DISCIPLINARY RECORDS THE SAME AS OTHER GOVERNMENT EMPLOYEES’ RECORDS

Hawaii’s Uniform Information Practices Act (UIPA), Chapter 92F, HRS, was amended to require the disclosure of police officers’ suspension information to be treated the same as for other government employees.  Act 47 was signed into law by Governor David Ige on September 15, 2020, and enacts HB 285, HD 1, SD 1, CD 1.

Among other things, the new law amends HRS section 92F-14(b) to remove the special exception from the disclosure of county police officers’ misconduct information for other than discharges.  Now, county police officers are treated like all other state and county government employees whose misconduct information is publicly disclosable after the grievance adjustment period has run for suspensions and not just for discharges.  OIP has revised the law posted on its website to reflect this change.
