Petition Sent to Registrar of the Land Court Must Be Disclosed to Parties
Under part III of the UIPA (personal records), Bureau of Conveyance appointees are entitled to access a petition concerning their appointment. However, because the persons signing the petition were given implied or express promises of confidentiality, the agency may redact identifying information, such as the signatures on the petition, but only to the extent necessary to protect the identity of sources who furnished the information to the agency. The provision in part III of the UIPA which protects the source’s identity under an express or implied promise of confidentiality does not preclude disclosure of any remaining information within the record.
