Job Eligibles List and Unsuccessful Job Applicants Information

[OIP Op. Ltr. No. 05-03 partially overrules this opinion to the extent that it states or implies that the UIPA’s privacy exception in section 92F-13(1), HRS, either prohibits public disclosure or mandates confidentiality.]

The UIPA’s personal privacy exception permits an agency to withhold public access to the names of unsuccessful eligibles for the position of Hawai‘i County Planner III. Based on the personal privacy and frustration of a legitimate government function exceptions to disclosure, the OIP advised that the following identifying information should be segregated from unsuccessful candidates’ applications before the records were made available: applicant’s signature; name; social security number; home and business phone numbers and addresses; driver’s license number; current and previous employers’ names and addresses; and names of immediate supervisors for current and previous employment. Furthermore, if public disclosure of a rating or examination score would result in the likelihood of actual identification of a certified eligible, then the rating or examination score must be withheld from public access.
