City’s DOH Employee Personal Records Must Be Released to UPW

The City and County of Honolulu’s Department of Health must provide the United Public Workers (UPW) with employees’ personal records that are relevant to the investigation or processing of a class action grievance involving the purging of derogatory information from employee personnel files. The OIP noted that under section 89-16.5, Hawaii Revised Statutes, public employees organizations must be allowed access to an employee’s personal records that are relevant to the investigation or processing of a grievance.

The OIP also observed that some of the personnel information requested by the UPW is specifically designated as public information under the UIPA, and that in accordance with a previous OIP opinion letter, employee leave records must be available for inspection and copying after the segregation of information concerning an employee’s medical condition.
