The OIP provided advice to the University of Hawaii concerning the disclosure of records maintained by the UH campus security unit, in light of amendments made by Congress to the federal Family and Educational Rights and Privacy Act (FERPA). These amendments clarify that records created by a campus law enforcement unit do not constitute “educational records,” the disclosure of which are restricted by FERPA as a condition of federal funding. The OIP also summarized a number of previous opinions it had issued discussing the disclosure of records or information compiled for law enforcement purposes.
