Confidentiality Agreements; Vendor’s Proposals
A government agency may not enter into a “confidentiality agreement” if confidentiality of the information subject to the agreement is contrary to the UIPA. Proposals submitted to an agency in response to a Request for Proposals may be confidential until the State has made a final selection, unless releasing them would result in the frustration of a legitimate government function.
