Special Treatment Facility Information
[OIP Op. Ltr. No. 05-03 partially overrules this opinion to the extent that it states or implies that the UIPA’s privacy exception in section 92F-13(1), HRS, either prohibits public disclosure or mandates confidentiality.]
Budget information submitted by organizations granted licenses to operate special treatment facilities, and personal information about the licensee’s employees and the residents in such facilities are protected from required disclosure under the UIPA. The budget information is confidential commercial and financial information and section 224-5, Hawaii Revised Statutes, provides that information directly or indirectly identifying a person who is a patient in a special treatment facility is confidential.
