Hawaiian Humane Society; Applicability of UIPA

[OIP Op. Ltr. No. 05-03 partially overrules this opinion to the extent that it states or implies that the UIPA’s privacy exception in section 92F-13(1), HRS, either prohibits public disclosure or mandates confidentiality.]

The Hawaiian Humane Society (HHS) is an “agency” subject to the UIPA. Based upon the totality of circumstances, the HHS performs a governmental function by enforcing laws enacted for the health, safety, and welfare of the public. Additionally, the society’s operations are subsidized primarily by public funds. Except for the home addresses and home telephone numbers of individuals granted dog licenses, information contained on an application for animal registration must be publicly available.
