SUNSHINE LAW TRAINING MATERIALS REVISED AND UIPA RULES STILL UNDER REVIEW
Posted on Aug 1, 2018 in Featured, What's NewThe Office of Information Practices (OIP) has updated and revised its Sunshine Law training materials, including the Sunshine Law Guide, various Quick Reviews, forms, and Sunshine Law Quiz, which can be found on the Training page at oip.hawaii.gov. The only materials left to update are the Sunshine Law training video and PowerPoint, so be on the lookout for a What’s New article when they are done.
No changes are expected to be made to the UIPA or Log training materials until new administrative rules are adopted. The formal rulemaking process has yet to begin as OIP is still awaiting legal review of its proposed rules by the Attorney General’s (AG) office before it can seek the Governor’s approval to go to public hearing on them.
OIP, however, has already begun to solicit public comments on the draft rules and explanatory materials that are posted on the “Laws/Rules/Opinions” page at oip.hawaii.gov. Among other things, comments were made in favor and against increasing the search, review, and segregation fees that were set 20 years ago, but there has been little discussion about the fee waivers that the draft rules would increase from $30 (or $60 for media) per request to $400 per year, which would keep record requests free or affordable for most people. Based on earlier comments, OIP has already made some revisions to the draft rules, which are incorporated into the proposed rules under review by the AG’s office, and OIP will have another opportunity to review the rules before beginning the formal rulemaking process.
