SAVE THE DATE FOR OIP’S BRIEFING ON DRAFT RULES AND SUNSHINE LAW TRAINING

All state and county government employees and members of the public who work with the Uniform Information Practices Act or Sunshine Law are encouraged to attend these presentations. ‘Olelo will also record the Honolulu presentation, which can be viewed on cable television or online at olelo.org and oip.hawaii.gov.
OIP’s Director Cheryl Kakazu Park and Staff Attorney Jennifer Brooks will discuss the draft of OIP’s administrative rules regarding the UIPA, which include new rules for personal record requests and changes to the record request fees and waivers. Additionally, there will be training on the new Sunshine Law provisions of Act 64, SLH 2017, which will go into effect on July 1, 2018, and include provisions requiring board packets to made available to the public, meeting notices to be filed online and sent by agencies to requesters via electronic mail, and meeting minutes to be posted online. As an alternative to written minutes, Act 64 will also allow meeting minutes to be a recording of the live meeting, so long as a written summary and the location of motions and votes on the recording are also provided.
The draft rules are being reviewed by the Attorney General’s office and are not currently available for distribution. The review is expected to be completed before the end of August, at which time OIP will post the draft rules on its website and notify people through a What’s New article. OIP will be soliciting public comments on the draft rules throughout the month of September. Depending on the public comments, OIP may make further revisions to the draft rules before it conducts a formal public hearing on the rules that it will propose later this fall.
OIP is also busy summarizing all state and county agencies’ UIPA Record Request Log for FY 2017, and will be examining the Log data before finalizing the draft rules. OIP thanks the agencies who have turned in their Logs and Checklists to OIP.
