OIP’s 2014 ANNUAL REPORT

The state Office of Information Practices has posted on oip.hawaii.gov its Annual Report for FY 2014.  While the attached report is based on OIP’s performance through the fiscal year that ended on June 30, 2014, the summaries of court cases monitored by OIP during the year were updated to be as timely as possible and includes a short description of the Hawaii Supreme Court’s decision in Molfino v. Yuen (WL 5905007) (November 13, 2014).  Consistent with prior Hawaii Supreme Court opinions, the attached Molfino decision made clear that the state’s Uniform Information Practices Act, HRS Chapter 92F, does not create a legal duty to maintain government records that would allow someone to sue in a tort action for negligence if the government records were not filed in an accurate, relevant, timely, and complete condition at all times.
