Department of Public Safety’s Standards of Conduct

The OIP opined that the “Standards of Conduct for the Department of Corrections” must be made available for public inspection and copying by the Department of Public Safety (PSD). Based upon a previous opinion regarding the standards of conduct of the Honolulu Police Department, and court decisions cited therein, the OIP concluded that the PSD’s standards of conduct were not protected from disclosure to the public under the UIPA’s “frustration of a legitimate government function” exception. Accordingly, the OIP opined that the PSD’s standards of conduct must be made available for public inspection and copying upon request by any person, including inmates in State correctional facilities.
